The Landing Homeowners:

On December 9, 2024, at the meeting held to count the votes concerning the proposed Second Amended Governing Documents, 92 ballots were counted out of the 126 properties within The Landing. The vote tally resulted in 69 votes in favor and 23 votes against the proposed documents, with 34 properties abstaining from submitting a ballot. During the meeting, members of the association proposed that the Board extend the voting deadline to allow the 34 non-voting members an additional opportunity to participate. As a result the voting deadline has been extended until January 26 2025.

NOTE: Previous ballots submitted to The Landing office by the original December 9th deadline have been officially counted and are deemed valid and binding. Once a ballot has been submitted and officially counted, it cannot be modified, rescinded, or replaced under any circumstances.

 

If you did not submit your ballot by the December deadline, please follow one of the processes below by Sunday, January 26-2025:

 Email: To submit your ballot, please download it here, fill it out, sign it and email it along with an attached copy of your driver’s license, to the Association office at LandingHOA@att.net.

 In-Person Delivery: Dropping it off at The Landing's office, in a sealed envelope, during office hours or in mail slot after hours.

 Regular mail: keep in mind that it must be received by the office by the due date, January 26 - 2025.

  The Board affirms that any ballot not received will not be presumed to constitute a vote “against” the proposed measure. A verified ballot submission is essential to maintaining the integrity of the association's decision-making process. Considering the significance of these governing documents, the Board acknowledges its fiduciary responsibility to ensure that every member has a fair opportunity to cast their vote—whether in favor or against the proposal—thereby providing the association with a definitive understanding of the collective position of its membership.

Please note that, apart from minor mechanical error corrections, such as spelling and punctuation, the only substantive revisions from the previously presented 2023 Declaration draft are the inclusion of the 'Delegation of Use Clause' in Article X and 'Leasing Restrictions' in Article XI, which include a 15% rental cap, prohibition of short-term rentals, and a sex offender restriction clause.

Your vote pertains to the documents in their entirety; individual sections may not be selectively approved or rejected.

To clarify any previous confusion, a vote “For indicates your approval of the final documents as presented, while a vote “Against indicates your disapproval of them.
